1. Protection of Vulnerable Adults (Pova) List - Important Announcement

Chief Executives of Health Authorities, Primary Care Trusts and Local Councils should ensure that managers and professionals charged with the implementation of the Protection of Vulnerable Adults (PoVA) list are aware that the implementation date has been delayed from April 2002 until August 2002.

Provision was made in Part VII of the Care Standards Act 2000 to establish a list of individuals judged unsuitable to work with vulnerable adults in the health and social care sectors. This will be known as the PoVA list and be maintained by the Secretary of State for Health. PoVA will create a workforce ban, by ensuring that people who have abused or mistreated vulnerable adults in their care do not find their way back into such positions again.

There will be a statutory obligation for employers/providers of health and social care services to be compliant with the PoVA list requirements from the August 2002 implementation date. The details of these arrangements will be outlined in Department of Health guidance, due to be issued for consultation shortly. Final guidance detailing how the PoVA list operates will be issued prior to August 2002.

NHS interest

2. Advance Letter (MD) 1/02 Implementation of Pay and Conditions for Hospital Medical and Dental Staff and Doctors in Public Health Medicine and the Community Health Service by the Review Body in 2002/2003

Following the recommendations of the Review Body for Doctors' and Dentists' Remuneration agreement has been reached on revised salaries for staff employed in the NHS on national terms and conditions.

Advance Letter (MD) 1/02 gives details of the pay for 2002/03 for hospital medical and dental staff.

Employers must ensure that the new pay scales detailed in the above AL are implemented quickly to allow staff to receive their increased salaries in April.

3. The NHS Chief Executives Panel

In February 2002 the NHS Chief Executive's Panel was launched for a three-month pilot period. The panel was created as a vehicle for gathering knowledge based on NHS experience, to inform advice, decisions and options presented to Ministers. It is also a quicker method of collecting some types of information.

The panel is a statistically representative group of chief executives drawn from all NHS organisations who have agreed to be available at short notice to answer questions from senior staff in the Department. It gives an NHS wide, representative view that will run alongside the Chief Executive's sounding board and the regular meetings held by the Chief Executive of DH and StHA chief executives, departmental directors and clinical directors.

Questions to the panel are also copied to StHA chief executives who have the opportunity to provide comments within the specified time scale. The final reply is copied to Nigel Crisp, StHA chief executives and the panel members.

4. Shifting the Balance of Power: New Arrangements for Managing General Medical Practitioner Appointments

The NHS Plan announced that the MPC will be abolished. This is scheduled to take place on 31 March 2002. From 1 April new arrangements will be in place to plan the NHS primary care workforce and to oversee the geographical distribution of General Medical Practitioners in England.

Interim advice on the new arrangements is now being issued to chief executives of PCTs, HAs, StHAs and Workforce Development Confederations. 5. Achieving and Sustaining Improved Access to Primary Care

This document has been produced by the Department of Health with key stakeholders. It offers advice to PCTs to help them achieve the access target in the NHS Plan, increase capacity and extend services in primary care, and develop demand management in primary and secondary care. The document includes essential information for PCTs including:

  • Definitions of the Primary Care Access Targets.
  • Information on the Primary Care Access Fund including the Access Incentive Scheme.
  • Information on the new SaFF milestone of 90% which has been set for March 2003.
  • Monitoring arrangements.
  • How PCTs can access the National Primary Care Development Team Primary Care Collaborative.

6. Primary Care Disciplinary Proceedings from 1 April 2002

Health authorities need to make special arrangements for disciplinary proceedings using the Service Committees & Tribunal Regulations, where these will span 31 March/1 April 2002, when the new authorities are created.

7. Extending Independent Nurse Prescribing within the NHS in England - a Guide for Implementation

The Department's Press Release of 4 May 2001 set out the Government's plans for the extension of prescribing responsibilities to more nurses.

The purpose of this note is to draw your attention to the document, "Extending Independent Nurse Prescribing within the NHS in England - A guide for implementation", which was published on 13 March. This document is being distributed to Chief Executives, Directors of Nursing and Chief Pharmacists in Health Authorities and Primary Care Trusts, as well as GP practices, community pharmacies and NHS Walk-in Centres. Would you please ensure that all relevant staff within your organisation are aware of the guide. 8. Helping to Ensure That All Women Have the Opportunity to Make an Informed Choice About Screening

The NHS Cancer Plan, published in September 2000, stated that people invited to participate in screening programmes need to understand the potential benefit and harm in doing so to be able to make an informed choice about whether to proceed.

In October 2001, the NHS Cancer Screening Programmes launched information leaflets to give women clear, honest and balanced information about the benefits and limitations of breast and cervical screening, meeting the commitment in the NHS Plan. Produced in conjunction with the Cancer Research UK's Primary Care Education Research Unit, the leaflets have received the Crystal Mark from the Plain English Campaign.

Talking Newspapers have helped in transcribe the leaflets into an audio format and the Royal National Institute for the Blind (RNIB) have developed the English Braille version of the leaflets. The leaflets have also been translated into five languages: Gujarati, Punjabi, Urdu, Bengali and Chinese (Cantonese). Italian, Spanish, Vietnamese, French, Farsi, Arabic, Hindi, Somali, Polish, Turkish, Greek and Ukrainian versions of the leaflets will be available from the screening programme's website shortly at: www.cancerscreening.nhs.uk

All women who are eligible for screening will be able to obtain a copy of the English audio tape and Braille version 'Breast Screening - THE FACTS' from their local Breast Screening Unit or GP surgery.

Women who require a copy of 'Cervical Screening - THE FACTS' will be able to request a copy of the leaflet in Braille or audio tape by contacting Health Promotion England Customer Services on 01235 465566. The translated versions are available from Health Promotion England and the screening programme's website at: www.cancerscreening.nhs.uk

9. Medical Devices Agency - Safety Notice and Device Alert

SAFETY NOTICE - MDA SN2002(07) Little Sister 3 and SES2000 Benchtop Steam Sterilizers (long chamber versions)

This Safety Notice was issued on 5th March 2002 to NHS Trusts, Primary Care Trusts and Health Authorities Chief Executives. As usual it was also issued to Liaison Officers of Trusts, Primary Care and Health Authorities for action and for onward distribution as specified in the Notice.

DEVICE ALERT - MDA DA2002(01) Pin-index Medical Gas Cylinders, Size C, D, E, F, and G: Potential Risk of Mismatch to Medical Devices

This Device Alert was issued on 11th March to NHS Trusts, Primary Care Trust and Health Authorities Chief Executives. As usual it was also faxed to Liaison Officers of Trusts, Primary Care and Health Authorities for action and for onward distribution as specified in the Notice.

10. LAC(2002)7 Guidance to Councils with Social Services Responsibilities on the Abolition of Preserved Rights

This circular contains statutory guidance for councils with social services responsibilities on the preserved rights transfer. From 8 April 2002 they will have responsibility for making residential accommodation for people who were independent sector residential care and nursing homes on 31 March 1993 and who were entitled to income support and preserved rights rates.
