1. Meeting the requirements of the Working Time Regulation
(Gateway reference 2544)
NHS and social care employers are being updated on compliance with the
European Working Time Directive following the Jaeger Judgement in the
European Court of Justice. The information outlines the position on resident
on-call working, compensatory rest and the individual opt-out waiver.

2. Controls Assurance Standards for 2003/2004 reporting
(Gateway reference 2194)
All trusts and strategic health authorities are required to produce a
Statement on Internal Control (SIC) to accompany their annual accounts
(see Chief executive bulletin
186). Returns required by 15 May 2004.

3. New General Medical Services (nGMS) documents
(Gateway reference 2588)
The Department of Health has published a set of documents on the new GMS
contract:
- Delivering Investment in General Practice - the full detail of
how the contract will work and what needs to be done to implement it
- a draft standard GMS contract, with an accompanying explanatory note
for primary care trusts
- a draft GMS Statement of Financial Entitlements for 2004/05, which replaces
the old Red Book
- draft GMS contract regulations.
These documents were all negotiated with the British Medical Association
and agreed with them and the NHS Confederation. Hard copies of Delivering
Investment in General Practice and a CDROM including all of these

4. Commissioning NHS dentistry: further guidance for
PCTs published on 29 December (Gateway reference 2553)
Information is now available on dental practice prescribing profiles.
It includes key messages on access and priorities, the allocation of £35m
capital and £15m revenue to support access, quality and choice,
the allocation of £5m capital for salaried primary dental care service
modernisation and the general principles underpinning the base contract
from April 2005. More

Social care interest
5. Amended continuing care (National Health Service
responsibilities) directions (Gateway reference 2608)
Consultation revealed that the Delayed Discharge (Continuing Care) Directions
did not make it sufficiently clear that people could request a review
of their assessment at the point of discharge, as had been discussed in
Parliament. As a result the directions were amended following the completion
of the consultation. The
amended directions are now open to consultation until 13 February 2004

6. Protocol for judicial case management in public
law Children Act cases - Circular LAC(2004)1 (Gateway reference 2622)
The Department for Constitutional Affairs has issued protocol to address
the difficulties caused to children and their families and the cost implications
resulting from the current delay in completing proceedings. The protocol
has six steps to streamline the key processes towards achieving a final
hearing within forty weeks. Directors of Social Services should ensure
their heads of legal services are aware of

9. Department of Health support for implementing the
Single Assessment Process (Gateway reference 2593)
The website for the Single Assessment Process has been updated. Also,
the Department will be running five events in February and March to focus
on issues such as consent, professional trust and information sharing,
as well as a chance to work through specific local problems.

12. Consultant Contract - its role in delivering

This free one-day national conference on 9 February is aimed at consultants,

14. Electro convulsive therapy (ECT) accreditation
service (Gateway reference 2610)
The national director for mental health has sent a letter to trusts which
provide ECT as part of their mental health services, recommending the
Royal College of Psychiatrists' ECT Accreditation Service. More

15. Prioritisation of further major capital schemes
in 2004 - guidance launched (Gateway reference 2290)
The department has launched a further prioritisation round for major capital
schemes that will report in the summer of 2004. Capital schemes that exceed
£40m at 2003/4 prices must submit strategic outline cases for national
prioritisation by 23 April 2004.
