1. HSC 2001/21, LAC 2001/30 Care Standards Act 2000 - (Commencement No 9 (England) and Transitional And Saving (Provisions) Order 2001 - Guidance to Local Authority and Health Authority Registration and Inspection Units on the Transfer of Registration for Existing Regulated Providers to the national Care Standards Commission and Other Transitional Processes
The Care Standards Act 2000 (Commencement No.9 (England) and Transitional and Savings Provisions) Order 2001, was made on 13th November. It requires current regulators to send a Transfer of Registration Form to all regulated providers. The form sets out the details of their current registration and the new types and categories of registration that will apply from 1 April 2002.

The Order also sets out the following:

  • What, if any, additional information providers must give before their registration can be transferred;
  • What happens where a decision to cancel registration has been taken or other enforcement action is ongoing;
  • The process for transferring some applications for registration from current regulators to the NCSC where these cannot be completed before 1 April 2002;
  • The process whereby managers, in certain provision, who were previously exempt from registration must make applications to the NCSC, and;
  • The process by which previously exempted provision must make applications to the NCSC for registration.

Please note that the Transitional Order is not yet available but will be soon.

2. National Institute for Mental Health in England - Role & Function

The consultation document, setting out in detail the roles, structures and functions which are envisaged for NIMHE, was distributed this week. Further copies of the document may be obtained from Department of Health publications by email: doh@prolog.uk.com or by fax 01623 724524; please quote reference 24167 when ordering. We would welcome your comments, and will consider responses carefully as NIMHE is established during 2002.

We are also arranging two open days where further detail on NIMHE will be presented, and there will be an opportunity for questions and discussion of the proposals. These are Tuesday 4th December 2001 from 10:00am to 2:00pm at Thistle Marble Arch Hotel, London and Thursday 24th January 2002 from 10:00am to 2:00pm at Marriott Hotel, Leeds. Places at these events are limited and will be on a first come first served basis. 3. A National Service Specification for Haemophilia and Related Conditions

The Haemophilia Alliance have produced a document to provide a specification for a service that allows haemophiliacs the best care that can be made available. The Government is determined to ensure that people with haemophilia are increasingly well cared for in the NHS, supported in their communities and more fully informed about how best to look after their health. Ministers have welcomed this model service specification which sets out clear standards of care for patients with inherited bleeding disorders.

The service specification builds on the considerable expertise of the Haemophilia Alliance in delivering multi-disciplinary, comprehensive patient care. It contains a number of recommendations for the delivery of effective, patient-centred services and brings much needed clarity into a complex area.

This document remains a model service specification and has not been endorsed as Government policy, but NHS commissioners of haemophilia services will find the document an invaluable resource when planning and developing services for patients. Document available at: www.haemophiliaalliance.org.uk

4. PL CNO (2001) 09 Community Budgets Funding 2001/2002 and Onwards

Letter from the Chief Nursing Officer dated 14th November 2001 setting out arrangements £3m of new money announced by Secretary of State on 1st November to provide community budgets for teams of community practitioners* in all parts of the country. He encouraged Primary Care organisations to match this new investment from the centre with resources of their own so that each locality team would have a community budget worth at least £5,000 per year.
*The term "community practitioners" in this letter refers to health visitors, school nurses, midwives and other nurses undertaking public health work in primary care

The community budgets are intended for PCTs or PCGs (Primary Care Organisations) to provide modest sums for community based public health work which can be accessed directly by teams of frontline community practitioners and health visitors. This is in keeping with the spirit of Shifting the Balance of Power and aimed specifically at Secretary of State's goal to tackle health priorities and inequalities. Examples could include hiring community venues, providing food for a cook and eat group, play materials for children, crèches, health promotion materials. Primary Care Organisations are required to set up budgets which can be accessed and managed directly by teams of community practitioners by 30th November 2001.

5. Increased Funding for Locum Cover for Family Doctors on Maternity, Paternity and Adoptive Leave
The Health Minister John Hutton, announced on 2 November in a joint press release with the GPC, increased funding for locum cover for family doctors in GMS and PMS on maternity leave and the introduction of locum reimbursement for paternity and adoptive leave. This includes:

  • An increase in locum reimbursement for maternity leave from up to 14 to up to 18 weeks (rising to 26 weeks by April 2003)
  • Funding for locum cover for paternity leave of up to 10 days
  • Funding for adoptive leave of up to 18 weeks if the child is below school age and up to three months for school age children

The changes were effective from 2 November 2001. Any doctor on maternity leave on or after that date will be entitled to the increased level of 18 weeks locum reimbursement.

Health Authorities and Primary Care Trusts are asked to note the changes to entitlement and take necessary action.

The current model claim forms for locum reimbursement (FP/LSR, LOC 1, 4 & 6 ) will be reviewed to take account of these changes and published as soon as possible.

6. New Information Leaflets for the NHS Breast and Cervical Screening Programmes

The NHS Cancer Plan stated that people invited to participate in screening programmes need to understand the potential benefit and harm in doing so to be able to make an informed choice about whether or not they wish to proceed. Information provided to those invited must be honest, comprehensive and understandable to its audience. The plan therefore set out the commitment that we will introduce new national information sources, which all screening programmes will be required to use.

New leaflets introducing informed choice into the NHS breast and cervical screening programmes were launched by Lord Hunt on Wednesday 31 October at the British Library.

7. Acute Trust Surveys

As notified in previous Bulletins, the acute Trust-based patient survey programme will begin at the end of this year, and results will be reported in time to inform the national performance ratings and performance indicators. For most Trusts, we would envisage beginning the survey in early January. The survey process will take approximately twelve weeks.

A detailed guidance pack will be sent to all acute Trusts early next month, (December) and a supporting website will be available at the same time. It will be from the website that Trusts will be able to download a Basic Survey, which includes all the mandatory questions. They will also be able to compile their own surveys, which will consist of the mandatory questions, plus their own optional selections from a range of 'bank' questions. Before the formal guidance material is made available, there are some important actions which we would urge Trusts to initiate:

  • assemble a small project team to oversee the survey
  • make a decision about surveying in-house, or using a DH-approved company
  • become familiar with the relevant timescales

Information to help Trusts prepare for the survey is available (in Portable Document Format) from this link. In particular it sets out the overall schedule for survey completion, from this month (Nov) onwards.

9.Draft Guidance on the IM&T Business Case Process

The Department has prepared updated and consolidated draft guidance on business cases for Information Management and Technology (IM&T) schemes in the NHS. The draft guidance is designed to consolidate and replace the guidance given in the NHS Capital Investment Manual and in circular HSG(95)48. The guidance may be found at www.doh.gov.uk/pfi in the section "Consultation Draft: IM&T Business Case Guidance".

The aim is to provide NHS organisations with guidance that is practical and easy to understand, and this draft has been issued for comment as well as information. Any comments on it should be sent by Friday 14 December to: it.guide@doh.gsi.gov.uk

10. SAFETY NOTICE - MDA SN2001(27) Programmable Hydrocephalus Shunts: Risk of Reprogramming During Magnetic Resonance Imaging (MRI) Procedures

This Safety Notice was issued on 2nd of November to NHS Trusts, Primary Care Trusts and Health Authorities Chief Executives. As usual it was also issued to Liaison Officers of Trusts and Health Authorities for action and for onward distribution as specified in the Notice.

11. LASSL(2001)11 Consultation On The Implementation Of The Adoption (Intercountry Aspects) Act 1999

The Adoption (Intercountry Aspects) Act 1999 will be implemented during 2002 and this, together with equivalent legislation in Northern Ireland, will allow the UK to ratify the 1993 Hague Convention on Protection of Children and Co-operation in respect of Intercountry Adoption.

To ensure all with an interest have an opportunity to contribute to the development of the Regulations and the guidance that will need to be issued when the Act is brought into force, the Department of Health has today issued a consultation document. This is enclosed. It outlines the way the new system will work, provides draft guidance and draft Regulations for your consideration, and seeks comments on a range of issues.

You are encouraged to consider the enclosed document and submit your comments on the proposals, using the proforma attached at annex E of the consultation document, by Wednesday 13 February 2002.
