NHS and social care interest
1. Employment contract termination - confidentiality
and clawback clauses (Gateway reference 2340)
The direction on use of confidentiality and clawback clauses in connection
with termination of a contract of employment - health service circular
2004/001 is now available. This direction applies to chief executives
and executive directors in connection with their termination of contract
of employment and termination payments. The directions come into force

2. Learning Disability Development Fund (LDDF) 2004/05
(Gateway reference 2666)
See the PCTs'
pro rata LDDF revenue allocations for 2004/2005. The funds will
be formally released by the start of the year. This site also contains
a letter to PCT chief executives about how these funds should be used.
This should be agreed, through partnership boards, with partner local
authorities. Decisions should take account of continuing commitments to
2003/2004 LDDF-funded learning disability projects, the needs of learning
disabled people with high support needs and of those from ethnic minorities.

3. Multi-agency public protection arrangements (MAPPA)
and the "duty to co-operate" (Gateway reference 2734)
The Criminal Justice Bill contains a statutory duty on health and other
bodies to co-operate with MAPPA. A
fact sheet summarising the background to MAPPA and the implications of
the bill

· issues which your experiences of MAPPA so far have thrown up
· examples of successful practice which might provide models for
others.

NHS interest
4. Publication of Payment by Results Core Tools 2004
(Gateway reference 2271)
The above document, containing reference costs 2003 and the national tariff
2004/2005, is published today (5 February). It will be accompanied by
the usual press briefing. Media interest is likely to be considerable.
Reference cost index scores were made available to NHS organisations on
3 February to enable them to prepare statements for local media enquiries.

allow, hopefully within two weeks.

5. 24/48 hour primary care access survey (Gateway
reference 2738)
From April 2004, access to an NHS Walk-in Centre (WiC) may count towards
local delivery of 24/48 hour access. For this to happen, the arrangement
for practices to refer patients to the local WiC must be covered by an
agreement between the practice and the WiC. The WiC must also have been
signed off by the PCT as providing suitable patient access. Otherwise,
the contents of the agreement are for local determination to take account
of local needs and circumstances. Revised guidance on the survey will
be issued after the current joint priority review and before the April
survey, but agreements can be prepared now.

6. Draft adoption regulations and guidance for consultation
(Gateway reference 2736)
The second consultation package of draft regulations and guidance to be
made under the Adoption & Children Act 2002 was published on 31 January
for a three month public consultation. The draft regulations and guidance
propose new restrictions on the preparation of adoption reports and new
arrangements for adoptions with a foreign element. A copy of the consultation
