NHS and social care interest

1. Change to the law-implications for employers
The Health Professions Council's (HPC) new register opened on 9 July 2003. Since then there has been a change in the law governing the twelve professions regulated by the HPC. The use of certain protected titles will now be limited to practitioners registered with the HPC as having approved levels of training and competence.

The Department of Health has issued an updated version of HSC 2000/006 and LAC(2000)8 which advises employers to ensure that appropriate arrangements are made to verify practitioners' HPC registration.

2. The Community care (delayed discharges, etc.) Act
The Act introduces a system of reimbursement for delayed transfers of patients who had been receiving acute care and whose delays are held to be the sole responsibility of the local authority. Delays incurred by patients receiving care from mental health services are not covered by reimbursement. Accordingly, the Department of Health is consulting on an order defining mental health services for the purposes of the Act.

3. Chief executive and directors of social services conference
This is a reminder to all chief executive and directors of social services about the conference planned for Thursday 4 September at the QE11 centre in London.

NHS interest

4. Freedom of Information (FOI) - Final reminder for publication scheme notification
The deadline to submit a declaration to the information commissioner to confirm compliance with a model publication scheme is 31 August 2003.

Declaration forms are at www.foi.nhs.uk/downloads/055b_inf_comm_nhs_models_declaration.doc

Schemes are required to be made public by 31 October 2003 and NHS trusts who fail to publish will be listed on the FOI website.

5. Reforming NHS financial flows: Introducing payment by results
This set out last year, reforms to the way money moves around the NHS. The document Payment by results consultation: Preparing for 2005 has now been published.

This identifies the key decisions needed for implementing the next stage of payment by results and outlines how it will apply to NHS foundation trusts from April 2004 and all NHS trusts from April 2005. It also includes further details of the reviews of levies for teaching, (multi professional education & training) and NHS R&D.

6. Health and safety compliance in the NHS 2002/2003
The Health and Safety Commission chair, Bill Callaghan, has written to all NHS chief executives, setting out the Health and Safety Executives (HSE) findings on health and safety compliance in the NHS during 2002/2003.

9. Positron emission tomography (PET) scanning
In response to requests for a framework to guide local commissioning the Department of Health is developing, in consultation with NHS and research stakeholders, a framework for PET scanning in the NHS. The framework will set out which tumour groups would benefit from PET scanning, likely future demand, and the implications for the optimal configuration and location of PET scanners.

12. Monitoring junior doctors' hours - September 2003
The regular collection of NHS trust data on junior doctors' hours, due to take place next in September is important, in the light of contractual changes and the implications of the forthcoming European Working Time Directive. 13. Guide to commissioning good services for falls prevention
This document supports delivery of the national service framework for Older People's integrated falls services. It will be of primary interest to falls co-ordinators, and those planning and commissioning components of falls services in PCTs and local authorities.
